These terms apply to all users of SafeDeal, including buyers, sellers, and visitors. By accessing or using our services, you agree to be bound by these terms. If you do not agree with any part of these terms, please do not use our services.Note: These terms are subject to change. We recommend reviewing them periodically for any updates.
Disclaimer: SafeDeal is not responsible for any transactions that occur outside of our platform. Always ensure you are using our secure escrow system for your transactions.
Warning: Any fraudulent activities or misrepresentation will result in immediate suspension of your account and possible legal action.
Important: Always verify the identity of the buyer or seller before completing any transaction. Use our identity verification features to ensure a safe experience.
Definitions
- Escrow: Funds held securely by SafeDeal until transaction completion.
- Delivery: Either confirmed receipt through SafeDeal or physical delivery tracked via our platform.
- Premium Seller: A verified and approved seller authorized to list refurbished or bulk items.
Escrow Fee: SafeDeal charges a flat escrow fee of 5% on every successful transaction. This fee is deducted from the seller’s payout and is non-refundable once the transaction is completed.
Shipping and Delivery Penalties: Sellers must ship items within 24 hours of payment confirmation. Delays beyond 24 hours may incur fines of up to 2% of the transaction value. If no shipment is confirmed within 48 hours, SafeDeal will automatically refund the buyer in full.
Buyer Collection Responsibility: If an item is delivered or arrives at the buyer’s designated location, the buyer must mark it as delivered or collect it within 24 hours. Failure to act within this window may result in fines. After 48 hours, SafeDeal reserves the right to release the funds to the seller.
Refurbished Items: Only confirmed Premium Sellers may list refurbished items. Listings that violate this policy will be removed.
Second-Hand Goods: Buy second-hand items at your own risk. SafeDeal does not guarantee quality or authenticity. Always inspect items thoroughly before marking them as delivered.
Payment & Reversals Policy
Payments made through SafeDeal are held in escrow until the buyer confirms delivery or the time window expires. Once funds are released from escrow (to either party), they cannot be reversed by SafeDeal.
In cases where a buyer initiates a reversal request before funds are released, SafeDeal may consider it. However, all reversal-related costs, including M-PESA transaction fees, shall be borne by the buyer.
If the seller has already received payment, the buyer must initiate contact with Safaricom and the seller directly. SafeDeal will not be liable for funds already released.
1. Account Registration
By creating an account on SafeDeal, you agree to provide accurate and verifiable information—including your full name, contact details, current location, and national ID number. You further agree to update this information promptly if any changes occur.
2. User Responsibilities
You are responsible for all activities under your account. Sellers must ensure that the items listed are genuine, accurately described, and priced fairly, while buyers must confirm their interest before initiating any transaction. Misrepresentation or fraud will result in the suspension or termination of your account.
3. Escrow Protection
Payments made through SafeDeal are held in escrow until the buyer confirms the item has been received in satisfactory condition. You agree that any disputes regarding a transaction must be raised within 48 hours of delivery. Failure to do so may result in the automatic release of funds to the seller.
4. Identity Verification
Users may be required to verify their identity using national ID documents and profile pictures. SafeDeal reserves the right to suspend or terminate the accounts of users whose identities cannot be verified or who are suspected of fraudulent activities.
5. Privacy
Your personal data is stored securely and is used only for transaction purposes and to enhance your experience on our platform. We do not sell, rent, or share your information with third parties except as required by law or necessary to operate SafeDeal. Please refer to our Privacy Policy for further details.
6. Limitation of Liability
SafeDeal is not liable for any direct or indirect losses arising from transactions that are not processed through our secure escrow system or from errors made by users. By using SafeDeal, you agree to hold us harmless in the event of unforeseen circumstances or fraudulent activities.
7. Dispute Resolution
All disputes must be raised via the SafeDeal dashboard within 48 hours of confirmed delivery. Our team will review and respond within 72 hours. Both parties agree to abide by SafeDeal’s resolution.
8. Amendments
SafeDeal reserves the right to amend these terms at any time. Users will be notified of any significant changes via email or through a notice on the dashboard. Continued use of the service after such amendments constitutes acceptance of the updated terms.
9. Account Suspension
SafeDeal reserves the right to suspend or terminate any user account that is found to be in violation of these terms, including but not limited to fraudulent activity, failure to ship or respond within required timeframes, repeated disputes, or abusive conduct on the platform.
10. Governing Law
These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SafeDeal operates. Any legal action or proceeding arising under these terms will be brought exclusively in the appropriate courts of that jurisdiction.
